In the event of a discrepancy between this agreement and any other document pertaining to Strode Experience's other programmes, these terms and conditions shall prevail, unless Strode Experience has expressly stated differently in writing.

Moving Strodesters Private Limited is an Indian company with its registered office in Mumbai, India, and cin: U50400PN2022PTC212184 (hereafter referred to as the company or by its brand "Strode Experience"). By purchasing Strode Experience, the member agrees to the most recent and valid version of the privacy policy, which may be found at (strode.tour/privacypolicy).
To create and register an account with Strode Experience, you must complete the registration process on the application (or other url provided by Strode Experience) by providing us with current, complete, and accurate information. When you register for an account with Strode Experience via our application (hence referred to as a "member" and collectively with other Strode Experience account holders, "members"), you will be required to supply us with your email address and password selection. You are responsible for maintaining the accuracy, completeness, and currency of your account information. You acknowledge that you are entirely responsible for the secrecy of your password and for all activities that occur under your username and password. Strode Experience suggests changing your password at least once every ninety (90) days. Strode Experience disclaims all duty for any loss, claim, or other liability resulting from the unauthorised use of any password. You agree to immediately tell us through email at info@strode.tour of any unauthorised use of your password or username, or any other breach of security. If you lose or steal your password, it is your obligation to change it promptly and alert us so that your account stays secure and functioning.
Info@strode.tour describes the procedure for making a booking by the member. Prior to or following the usage of the services, the member is obliged to supply the following documents on the requisition of Strode Experience: (a) identification document, such as an Aadhaar card, a pan card, or a passport.
We will charge you for Strode Experience's rental services. You agree to pay for all rental services purchased through Strode Experience, and that we may charge the credit or debit card account you provided when enrolling for the service for the rental services (including all applicable taxes and late fees). You are responsible for paying all fees on time and maintaining a valid credit or debit card account to cover all fees at all times. Payments are refundable at Strode Experience's exclusive discretion. Additionally, we may place an authorization hold on your credit or debit card at our sole discretion to cover any fees, damages, or other similar amounts that may occur. We connect your credit or debit card account to the application and service via a third-party payment processor (the "payment processor"). Payments or credits, as applicable, in connection with your use of rental services will be subject to the payment processor's terms, conditions, and privacy policies, in addition to this agreement. We are not liable for any payment processor errors.

The bike should be picked up from a Strode Experience station and returned to the station and the customer expressly declares to receive the electric bike in perfect conditions and undertakes to return it also in perfect conditions.
2.
The customer undertakes to pay in case of damages the electric bike might have allowing e-bike rent to put charges for repair costs on the client’s credit card or debit card or through any payment method used by the customer.
3.
The customer is not allowed to return a rented bike after the date and time stated in the contract. Bikes must be returned to the same station and during the business hours of Strode Experience, for more information please check on the application:(www.strodebike.com). One day is considered to be 24 hours.
4.
Strode Experience is not obliged to give any refund for rented bikes that are returned before the end of the contractual period.
5.
For each hour that the rental period is exceeded Strode Experience is entitled to charge customers <%> of the daily rental price on top of the actual rental price, with a maximum charge of 5 hours for the first day. For each following day, a maximum of 150% of the rental price can be charged.
If the electric bike is not returned on time, Strode Experience is entitled to take back the electric bike immediately.

Customer must treat the bike well and in accordance with its actual purpose.
2.
Customer must return the bike to Strode Experience in its original condition. Any changes or additions by or on behalf of the customer must be undone.
3.
By renting a bike or joining a bike tour, the customer declares to be: a. In good physical condition, i.e. not suffering from any medical diseases or complaints that influence their riding ability. b. Able to properly ride an electric bike.
Strode Experience reserves the right to judge the capacities and abilities of a customer or rider prior to the use of an electric bike. Both for bike rental and bike tours, the customer must obey all traffic laws and instructions from Strode Experience staff. The customer/rider must behave as a good renter/rider, which means he/she: is not permitted to sublet or sublease the bike. Is not permitted to give the bike to a person other than the rider. Is not permitted to take the bike outside of Maharashtra. Must ensure that the person who is contractually indicated as the rider is legally permitted, and physically and mentally fit enough to ride a electric bike. Must secure loads on the bike with due care. Is not permitted to continue using the bike if it’s damaged, when its use can lead to aggravation of the damage or affects traffic safety.

The customer must return the electric bike in a clean condition. Cleaning costs with a minimum of Rs. 200/- (Two Hundred) may be charged.

Customers must bring a copy of the booking receipt with them upon returning the bike.
Customers must never leave the electric bike unattended unless properly locked. At the start of the rental or tour, the customer needs to check the bike and report any possible defects to Strode Experience staff. When the defect(s) cannot be repaired instantly, the customer is permitted to have a replacement bike. As soon as the customer leaves the Strode Experience station, he accepts the condition of the bike.
Unless expressly agreed upon otherwise, each member can book only a single bike at any one given moment.
Strode Experience collects, stores, processes, and uses members' personal data, including but not limited to their name, e-mail address, internet protocol address, copy of their driver's licence, and any other additional address or identity proof, as well as their image, to the extent necessary for the administration and implementation of this agreement and the members' use of Strode Experience services. If third-party services are utilised, Strode Experience is authorised to share members' personal data with the third-party service provider to the degree necessary to accomplish Strode Experience's objectives. Strode Experience is responsible for implementing and maintaining adequate policies to safeguard sensitive personal information in accordance with applicable law. Strode Experience shall have the right to disclose information to its parent company, to all companies controlled by Strode Experience or any of its affiliates, and to any government body as required by law/or by directive/or upon request from any government body or any third party deemed fit and property by Strode Experience, in its sole discretion. Regardless of anything written below, member shall be bound by Strode Experience's privacy policy.
The Strode Experience Platform may contain content that is protected by copyright, trademark, and/or other laws in India and other countries. You accept that Strode Experience and/or its licensors own all intellectual property rights in the Content and agree not to remove, modify, or obscure any copyright, trademark, service mark, or other proprietary rights notices. Except to the extent that you are the legal owner of the Content or as expressly permitted in these Terms, you may not use, copy, adapt, modify, prepare derivative works of, distribute, licence, sell, transfer, publicly display, publicly perform, transmit, broadcast, or otherwise exploit any Content accessed through the Strode Experience Platform. Strode Experience hereby grants you a limited, non-exclusive, non-sublicensable, revocable, and non-transferable licence to I download and use the Application on your personal device(s); and (ii) access and view the Content made available on or through the Strode Experience Platform and accessible to you, solely for your personal and non-commercial use.
In no event will the Strode Experience parties or it subsidiaries be liable to you or to any other person or entity for any claims, damages, injury, direct, indirect, consequential, exemplary, incidental, special, or punitive damages, lost income, revenue, or profits, lost or damaged data, or other commercial or economic loss arising out of this agreement or in connection with the use of the application, the service, or any application to which they are linked, regardless of the form of act. The members' cumulative responsibility for all causes of action and theories of liability will be limited to and not exceed the booking amount for the services paid by the members.
Strode Experience reserves the right at any time, with or without warning, to modify, edit, delete, suspend, or cancel our application or service (or any portion thereof). You acknowledge and agree that we will not be liable to you or any third person for any change, editing, deletion, suspension, or discontinuance of the application or service.
Strode Experience reserves the right, in our sole discretion, to restrict, suspend, or terminate your account or your access to all or any portion of the application and/or service at any time, for any or no reason, with or without notice, and without liability. You may cancel your subscription at any time by emailing us at info@strode.tour. Please give us adequate time to process cancellation requests. Strode Experience is under no obligation to save your user profile, communications via the application, or any settings, information, or content you have posted on or transmitted through the application following the cancellation or termination of your account by you or Strode Experience for any reason. You understand and agree that, following termination, we reserve the right, but not the responsibility, to delete any of your account information or other content.
If a court of competent jurisdiction rules that any provision of this agreement is invalid or unenforceable, the parties agree that the court should endeavour to give effect to the parties' intentions as expressed in the provision, and the remaining provisions of this agreement remain in full force and effect. Our consent to a violation of a provision of this agreement or our failure to act in response to such breach does not constitute a waiver of our right to act in response to subsequent or similar breaches. Similarly, our omission or delay in exercising or enforcing any right or term of this agreement shall not be construed as a waiver of that right or provision.
This agreement and the relationship between you and Strode Experience are governed by the laws of India, without respect for rules of conflict of laws. Any disagreement between the parties that is not arbitrable will be addressed in the courts of Maharashtra.
You acknowledge that your use of the Strode Experience Services is entirely at your own risk and subject to the following terms and conditions:
Strode Experience expressly disclaims all warranties, express or implied, with respect to the service and your use of it, including, without limitation, implied warranties of merchantability, fitness for a specific purpose, and non-infringement. We offer no guarantees or claims about the accuracy or completeness of the service's content or the content of any third party linked to the service, and we will bear no liability or responsibility for any of the following:
1.
Content and material errors, omissions, or inaccuracies.
2.
Any physical injury, disease, death, or property damage of any kind caused by your access to and use of the service, or by your use of any third-party services that may or may not be connected to Strode Experience.
3.
Any failure or interruption of transmission to or from the service,
4.
Any inaccuracies or omissions in any content or materials, or for any loss or damage of any kind incurred as a result of the use of any content posted, sent, or otherwise made accessible via the service.
We make no representations or warranties about any product or service advertised or offered by a third party through the service, and we will not be a party to or in any way responsible for monitoring any transaction between you and any third-party providers of products or Strode Experience Services. As with any purchase of a product or service made via any medium or in any setting, you should use caution when necessary.
Strode Experience shall also not be liable for damages resulting from the use of or inability to use the website or application, including – but not limited to – damages resulting from electronic communications failure or delay in delivery, electronic communications interception or manipulation by third parties or by computer programmes used for electronic communications, and virus transmission.
The quality of the Services requested through the Platform is entirely up to the service providers who ultimately offer such Services to you, and Strode Experience is not responsible for the same. However, any complaints regarding the Services provided by the Service Provider should be made to the Company by email at the address specified on the Company's website from time to time.

We provide you with the ability to read reviews submitted by other users as well as other content and photographs related to the activity on the Strode Platform. These reflect the user's personal view at a certain point in time and are thus impacted by personal beliefs and expectations. Additionally, the activity may have changed since the material or rating was posted. Additionally, the amount of ratings should be considered, as a single view is frequently less important than a summary of a big number of ratings.
2.
You can have a direct impact on the Strode Platform's content by writing reviews of Activities for which you have paid or, if applicable, by uploading photographs ("User Content"). You are entirely responsible for User Content that you upload. It is strictly prohibited to post User Content on the Strode Platform that is false or misleading, in particular to make false and/or unobjective assessments of Activities or other circumstances/events that could influence the decision of other users, openly or covertly advertises products, services, or companies; in particular, provides reviews, insofar as the user is compensated for this action, or provides reviews of the Activities of a Supplier for whom the user receives compensation.
3.
Additionally, you are responsible for ensuring that you have the relevant permissions of use for photos prior to uploading user content. Particularly, photographs or photos containing individuals other than may be uploaded to the Strode Platform only with the approval of these individuals. If you wish to utilise photographs taken by someone other than yourself, you must also obtain their authorization.
4.
Public accessibility of User Content must not violate legal provisions, morality, or the rights of third parties; in particular, you may not upload or make publicly accessible any User Content depicting violence, pornography, discrimination, insults, racism, defamation, or other illegal content or depictions.
5.
In no manner or circumstance do we claim the User Content as our own.
6.
We may make a variety of uses of User Content. This includes presenting it on the Strode Platform, reformatting it, altering it for clarity or better grammar, and incorporating it in or alongside adverts or other works.
7.
We reserve the right to remove or repost User Content as needed and at our sole discretion. We are not bound to retain or provide copies of User Content.
Strode Experience, its affiliates, and partners may place adverts and other content alongside or alongside User Content on the Strode Platform and in other media. You are not compensated in any way for these adverts. We have the right to modify the nature and extent of such advertising tactics at any time without notifying you.
1.
The user warrants that he or she will operate the Vehicle in accordance with all applicable laws and will not engage in any illegal or unlawful activity while operating the Vehicle.
2.
The user is liable for all expenses and fees incurred in connection with the Vehicle throughout the reserve term and until the Vehicle is returned in an acceptable condition to the Strode Experience Station.
3.
The user agrees and understands that Strode Experiences expressly bans the following uses of the Vehicle:
1.
With more than one (1) traveller;
2.
Being under the influence of alcohol, narcotics, or other prohibited substances, or smoking tobacco or tobacco products in the vehicle;
3.
Participating in or preparing for any type of race, event, competition, or stunt;
4.
Without prior authorization from Strode Experience, tampering with, disassembling, or otherwise altering the vehicle or any of its parts;
5.
Unusual usage, irresponsible riding methods, overstressing and mishandling the e-bike, resulting in excessive wear and damage to the vehicle's components;
6.
Carrying illegal/hazardous/prohibited material;
7.
Attaching any external structures to the e-bike causing damage to the vehicle or other related components;
8.
If you commit any violation while operating or involving the Vehicle, you must immediately alert Strode Experience.
You acknowledge that you will be solely responsible for any fines/penalties associated with such violation, and that Strode Experience will have no liability in connection with the same.
